Tenancy advice for tenant re illegal entry?
I moved into my flat mid December, since then I have notified my landlord that I beleived someone was gaining entry by using a key.
They told me that I was imagining things and that it was nothing to worry about.
I went home yesterday and found that my flat had indeed been entered.
I always lock my door, but after work I found that my door was not only unlocked, but wide open.
I have contacted the landlord to say that I want to move out, that I do not feel safe and that I feel myself and my belongings are in danger.
The landlord has told me that if i leave now I am breaking my tenancy, they will keep my deposit and they will start legal proceedings for the remainder of my rent.
Can anyone offer any advice?
Even if the locks were changed now, I dont want to live there
The first time that you contacted the landlord about it, you should have agreed to have the locks changed. You cannot change the locks without the landlord's permission, and he wouldn't have withheld permission unless he was the one entering, which is highly unlikely. It's more likely that the culprit is the tenant who resided there before you.
Unfortunately, I understand that the situation now so unpleasant for you that you don't want to stay there, but the landlord is correct - if you left now you would be breaking your lease, and he is entitled to take you to court. If you don't want this to happen then your only option is to change the locks and just stay there.
